Welcome to Blushu! These Terms and Conditions ("Terms") govern your access to and use of our website www.blushu.in (the “Site”) and any cosmetic and perfume products or services offered through it. By accessing or using the Site, you agree to comply with and be bound by these Terms. Please read them carefully before using the Site or making a purchase.

1. ACCEPTANCE OF TERMS

By accessing or using the Site, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Site.

2. ELIGIBILITY

You must be at least 18 years old to use the Site and make purchases. By using the Site, you represent and warrant that you are 18 years or older and have the legal capacity to enter into a contract.

3. PRODUCTS AND SERVICES

Blushu offers a wide range of premium cosmetic and perfume products for sale, including makeup, skincare, fragrances, and related beauty items. All products are subject to availability, and we reserve the right to withdraw or amend our offerings at any time without notice.

4. PRICING AND PAYMENT

All prices listed on the Site are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. The price you see at the time of purchase is the final price. We accept various forms of payment, including credit cards, debit cards, digital wallets, and UPI, commonly used in India.

5. ORDER ACCEPTANCE AND CANCELLATION

When you place an order through the Site, we will send you an order confirmation email. However, the order is not considered accepted until we process it, and you will be notified of any issues or delays. We reserve the right to cancel or refuse any order at our discretion. In such cases, you will be notified, and any amounts paid will be refunded.

6. SHIPPING AND DELIVERY

We will ship your order to the address provided during checkout, within India. Shipping costs and delivery times may vary based on your location within India. We strive to deliver orders in a timely manner, but we are not responsible for delays caused by external factors like weather, transportation issues, or local regulatory processes. Once an order is dispatched, the customer assumes responsibility for the items.

7. RETURNS AND EXCHANGES

We strive for customer satisfaction, and in case you are not completely satisfied with your purchase, you may be eligible for a return or exchange. Please refer to our Return and Exchange Policy for detailed information about the process, eligibility criteria, and timelines, which will be available on our Site. However, due to the nature of cosmetic and perfume products, items that have been opened or used cannot be returned unless defective or if there is an issue with the product quality upon arrival.

8. WARRANTY AND QUALITY

We guarantee that all Blushu cosmetic and perfume products sold on the Site are made with quality ingredients and adhere to the specifications mentioned on the product description page. However, as with any product, normal use and individual skin sensitivities may vary results, and we do not guarantee that the products will be free from all reactions in all users.

9. INTELLECTUAL PROPERTY

The content of the Site, including text, images, graphics, logos, and design elements, is the intellectual property of Blushu and is protected under Indian and international copyright laws. You may not reproduce, distribute, or use any content from the Site without prior written consent from Blushu.

10. USER CONDUCT

You agree to use the Site in a manner that is lawful and respectful of others. You will not:

  • Violate any laws, regulations, or rights of others.
  • Attempt to harm, hack, or access the Site’s backend systems or any other unauthorized areas.
  • Engage in fraudulent activities, including the submission of false or misleading information, including reviews or ratings.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Blushu, located in Chennai, Tamil Nadu, India, shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use or inability to use the Site or any products purchased through the Site.

12. INDEMNIFICATION

You agree to indemnify and hold Blushu, its affiliates, officers, and employees, harmless from any claims, losses, damages, and expenses, including legal fees, arising out of your use of the Site, any breach of these Terms, or any infringement of third-party rights.

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of India. Any disputes arising from or in connection with these Terms shall be resolved by arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The place of arbitration shall be Chennai, Tamil Nadu, India.

14. AMENDMENTS TO THESE TERMS

Blushu reserves the right to modify or amend these Terms at any time. Any changes will be posted on the Site, and the revised Terms will be effective immediately upon publication. It is your responsibility to review these Terms periodically.
